The need for a dialogue of epistemes in the legal investigation. A space for the construction of hermeneutic knowledge
Abstract:
Faced with the conception that prevailed during the 19th century and the first half of the 20th, which reduced legal reality to the mere literality of the norm, what has become known as the hermeneutical turn arises, which has resulted in the recognition of the principles in the interpretation of law. Law is no longer understood exclusively as the application of laws, rules, and the subsumption of practical cases to abstract and general norms, but as an action inspired by principles that are a guarantee of the practical rationality of law. This work proposes an analysis about the interdisciplinary epistemic dialogue, made possible by legal hermeneutics, analyzing said paradigm as the new emerging rationality within the field of Law.
