Tutela constitucional para proteger la semilla criolla en le Ecuador
Abstract:
To understand the theme and focus more on it is necessary to know that the transgenic crops Ecuador items not legally exist, except for a flower for export, raised in greenhouses. With no regulation in this area and that Ecuador is considered a country free of transgenic crops and seeds, this premise is also supported by the Constitution in Article 401, unfortunately in the same article there is an inconsistency because while states that Ecuador is free of transgenic also empowers they may introduce seeds and genetically modified crops. With this research work seeks to protect seeds through a constitutional guarantee to ensure the permanence in the territories of small farmers and indigenous peasants; conservation variety of seeds; strengthening and defending indigenous and peasant cultural identities; food sovereignty. With this guarantee what is achieved is that people do not lose their identity, food sovereignty and heritage. The conservation of seeds is very relevant in the power of decision when choosing what kind of food, you should eat, and what type of agriculture is used based on food sovereignty, trying to ensure seed reproduction seeing the needs and traditional knowledge without relying on any transnational….
