VAGUETY IN THE ECUADORIAN LEGAL ORDER REGARDING THE PROGRES¬SIVE USE OF FORCE


Abstract:

The progressive use of force is one of the principles that must be applied by the different State security institutions, especially the National Police of Ecuador, which is in charge of ensuring public order and citizen security, the use of force. It is accepted by international organiza¬tions and the Ecuadorian constitution, which internationally is comprised of five levels, the lethal type being the most controversial and the one that instills the greatest fear in police servants at the time of being employed, considering that it is not adequately found. regulated, the police try to avoid it as much as possible, since they are the ones who are most at risk of being harmed by regulations that apply rigorous disciplinary measures or unfair judicial processes, therefore, the legal system has been analyzed in relation to progressive use of force, which made it possible to determine the existing regulatory shortcomings; for this, an investigation was carried out Documentary, analyti¬cal, synthetic vestigation, and it was determined that there is normative vagueness in the regulation of the use of force, which generates insecurity in police activity, and consequently, greater insecurity in the general public.
