VIOLATION OF THE MAINTENANCE PROCEEDING, IN THE GUARANTEE OF DEFENSE

Abstract:

The present research work sought to determine the existence of violation to the due process in matters of alimony due to lack of timely summons to the obligors, in the Family Unit of the canton La Maná, period 2020, this is a problem that has been occurring within the judicial field in matters of children and adolescents, which consists in that, in matters of minors when the lawsuit is filed, the computation of the monthly payments due is initiated against the father, without the need of summons, which in the opinion of an important sector of the doctrine constitutes a violation to the due process of the defendant, The research was developed through a methodology based on a mixed approach, which was formed by a quantitative approach that was applied at the time of statistical analysis of the surveys applied, as well as a qualitative approach at the time of analysis of the selected cases of the Family Unit of the Canton La Mana.
