INFORMATION AND HUMAN RIGHTS. THEORETICAL APPLICATIONS TO THE EQUATOR
Abstract:
The right of access to information empowers citizens to obtain information held by public bodies and encompasses the right to request and receive information, as well as the obligation of governments to proactively publish information. With information, civil society activists and the public are equipped to participate in public debates, engage directly and in an informed manner with public decision-makers, and have their rightful voice in the development of public policies and laws. Objective: assess theoretical aspects applicable in Ecuador of the right of access to information, as a fundamental right. Scientific methods: empirical-logical, deductive and deductive, in addition to the technique of observation and analysis of documents. They allowed us to analyze the object of study and evaluate certain applications in Ecuador, substantiate said logic and arrive at thoughtful reflections based on this. Conclusions: The right to access information is recognized as a fundamental right by the main human rights bodies and courts in the world; it is an essential component of a democratic society. Access to information provisions are important because they help push for stronger laws; encourage proactive transparency and monitor implementation. The obstacles to the effective and successful implementation of the right of access to information lie in deficiencies in the quality of the legal framework; other laws in conflict with access to information; Lack of citizen awareness and administrative cultures of secrecy. The transparency requirements applicable to Ecuador theoretically conceptualize the foundations of these postulates. Its requirements and conceptualization should improve transparency and promote public input into decision-making processes. The studies related to doctrinal and conceptual aspects substantiate the right of access to information in an effective and efficient way. Its development and management are necessary and adapt the future of these precepts. Applying and adapting them is an imperative need for states.
