Challenges of habeas data in the protection of personal data in the Ecuadorian legal system
Abstract:
Introduction: The article addresses the challenges of habeas data in the protection of personal data in the Ecuadorian legal system. Through a comprehensive analysis, the limitations and strengths of habeas data as a legal tool to safeguard the privacy and personal information of citizens are examined. The study reviews Ecuadorian legislation, relevant jurisprudence and compares the regulatory framework with international standards. The main barriers are identified, such as the lack of clarity in the regulations and insufficient awareness about digital rights. Methodology: The research uses a qualitative approach, using documentary analysis and interviews with legal experts. Results: The results reveal an urgent need to reform and update existing laws, as well as improve education on personal data rights among the population. Discussion: focuses on the importance of a robust and adaptable legal framework that can respond to emerging technological challenges. Conclusion: Although habeas data is a valuable tool, its effectiveness depends on political will, legislative updating and social awareness.
