BREACH OF THE PRINCIPLE OF EQUALITY IN THE JOB STABILITY OF THE POSITION OF FREE REMOVAL


Abstract:

This Scientific Article analyzed Ruling No. 3-19-JP-20, No. 185, which violates the principle of equality and non-discrimination, in that it has given the position of trust an unequal treatment before the positions of occasional service contract and provisional appointment, with respect to the guarantee of the acquired right of reinforced labor stability of women. Therefore, the objective of the investigation is to determine the violation of the principle of equality in the reinforced labor stability of the position of free removal, with respect to Ruling No. 3-19-JP-20, in No. 185. Since this is a qualitative research, the purpose of which is to determine how the principle of equality and non-discrimination is violated in the reinforced labor stability of the position of trust, with respect to Judgment No. 3-19-JP-20, No. 185; describing and identifying how it occurs; the documentary analysis method is used to support the doctrine, internal legislation and comparative law, making considerations of legal rigor, where the violation of the principle of equality and non-discrimination is shown and was able to be demonstrated.
