Bad medical practice and its legal consequences in Ecuador


Abstract:

Bioethics as a science contributes to the transformation of society from the legal protection for damages generated by medical bad practices; hence it becomes an important tool for the protection of human beings. This investigation is developed with the purpose of describing medical malpractice and its legal consequences in Ecuador. To characterize this problem that affects the quality of the public health system and the interests and rights of human beings, we analyze two sentences related to medical malpractices that caused significant damage to the victims of wrongdoing. The analysis of the legal regulations shows that in Ecuador responsibility for medical malpractice is only required if the person dies as a result of this bad behavior, which leaves aspects such as psychological affectations, partial disorders that affect motor qualities and other affectations in a state of indefiniteness. This involves an analysis of the legislation in force in the country and a statement by the Ecuadorian legal community to protect those who suffer from medical malpractices.
