Causas que determinan el archivo de la denuncia de violencia psicológica. Estudio de expedientes en la fiscalía del cantón La Troncal, año 2019.

Abstract:

The crime of psychological violence, being the most reported, is the least prosecuted in Ecuador. The present work called “Causes that determine the file of the complaint of Psychological Violence. Study of files in the Prosecutor's Office of the “cantón La Troncal”, year 2019” in the Province of Cañar; examined a sample of 245 files under investigation phase which contained the request for closing them; from a universe of 351. Quantitative and qualitative methods were used; the documentary technique, for theoretical and normative support on psychological violence; and field technique, for the exploration, analysis and description of the content of the aforesaid files, were applied. The personnel from the public prosecutor local office, involved in the investigation procedure, were interviewed. This research had an ex post facto design. It was concluded that there are three reasons that motivate the filing of these causes and that there is a need for having a protocol or a guideline for the judicial system to apply in favor of the victims of psychological violence which in return will raise of the prosecution rates.
