AFFECTIVE DISORDERS CAUSED BY A UNILATERAL DIVORCE, A STUDY IN THE PROVINCE OF TUNGURAHUA, ECUADOR

Abstract:

This research addresses an alternative that has been implemented by several legislations worldwide to terminate the marital bond, we are talking about the uncontested divorce. The objective of the research was to determine the need to establish an adequate time for decision making in the case of unilateral divorce without grounds, in order to guarantee the right to mental health of the spouses and the members of the family nucleus. For which we worked under a quantitative research, with a non-experimental approach of transversal type with the technique of the survey to law professionals and mental health professionals of the province of Tungurahua. The main result confirms the importance of determining a time of 6 months before terminating the marital relationship in order to rule out or treat pathologies associated with mental health that influence the decision making of both plaintiffs and defendants regarding their marital situation.
