ANALYSIS OF INCOME AND POSSESSION OF CELL PHONES IN DEPRIVATION CENTERS OF LIBERTY OF SANTO DOMINGO-ECUADOR


Abstract:

When the Comprehensive Organic Criminal Code of 2014 entered into force, in article 275, it includes within the criminal ty-pes, the so-called entry of prohibited items to the Ecuadorian Deprivation of Liberty Center such as cell phones. According to officials of this type of center and data from the Judiciary of Santo Domingo, there was evidence of an increase in convictions for this type of crime in prisons. For this reason, it is imperative to carry out an analysis of the entry and possession of cell phones in detention centers in Santo Domingo, for compliance cauli-quantitative methods were used in the review of current legislation linked to the use of interviews with inmates, officials, and family members. It was evidenced that there is no illegality by not injuring or threatening a protected legal right, requirement determined in the criminal law so that it can be defined as a criminal offense in accordance with article 18 of the Organic Comprehensive Criminal Code, by punishing people in Ecuador for a crime that does not meet the conditions required by law and imposing a penalty imprisonment from 1 to 3 years.
