Conceptual mapping for the understanding of the role of motivation in the appeal


Abstract:

Motivation is vitally important in trials, especially when the appeal is used. Despite this, it is often not taken into account for criminal prosecution, especially since the introduction of oral trials. Therefore, it is necessary to ensure that the jurists and those involved understand the basic concepts related to this issue in order to achieve homogeneity in the processes and compliance with the provisions of the legislation on due process. This will respect the human rights of those involved. The objective of the article is to achieve an understanding of the role of motivation in appeals in civil trials. To this end, concept maps will be applied as a tool because they allow for learning and knowledge.
