Consecuencias jurídicas de la discrecionalidad oficiosa de abandono centro del proceso contencioso administrativo.

Abstract:

The declaration of abandonment in the Contentious Administrative proceedings for non attendance to one of the hearings indicated by the GOGEP, is a direct violation of a Constitutional Guarantee, this is due process, taking into consideration the direct discrimination to the actor from the point of view of that only the one presenting the demand is the adjustment of the measure, taking into consideration that the legislator left out the level of prejudice to one of the parties, the present investigation is projected to compensate the damage already caused to those who have seen affected by Article No. 87 effects of the failure to appear at the hearings and leave a precedent to the direct violation of due process and overlooking the effective judicial protection granted by the State as a guarantee.
