Abstract:

This article examines the judicialization of the right to housing, centered on three structural cases in Bolivia, Ecuador, and Venezuela. The work proceeds with a theoretical-deductive approach that addresses the New Latin-American Constitutionalism, presents the essential contents of the right to housing in international instruments and national regulations, and describes the judicial protection actions initiated by social movements. The research includes a qualitative analysis of judicial decisions, public documents, and interviews with key actors in the three countries. Then, the text presents the core concepts and the instruments for the protection of rights mobilized in each case, as well as their impact on the redefinition of public policies at the national level.
