Abstract:

The control of legality consists of the verification of the actions of the public administration by the administration of justice, at the request of a party, in order to establish whether the acts issued by the administration are subject or not to the principle of legality, achieving in such a way to comply with the rights to due process, effective protection and legal security, in addition to that, it is possible to impose a limit against the power of the State. As a general rule, legality control is practiced in contentious administrative-tax lawsuits, however, in actions related to consumer rights, it is the judge of violations who practices said control, when the supplier of the product or service is the Condition.
